Right to Work

In an attempt to minimise the number of people working illegally in the UK a system has been put in place where employers are asked to request suitable documentation to prove the identity of potential employees. This system requests that all prospective employees are asked to provide a document or a combination of documents from two lists.

New laws to tackle illegal migrant workers came into force on 29th February 2008 which mean that employers face higher fines for employing illegal workers. Under the new regulations, which form part of the Immigration, Asylum and Nationality Act, firms face fines of up to £10,000 per staff member (previously £5,000 maximum) or worse still a two year prison sentence for knowingly employing illegal workers.

TeamSpirit’s HR module provides companies with the facility to monitor and record information relating to new employees in respect of employee right to work identification. The system provides the ability to record what forms of identification have been produced by the employee i.e. a valid Passport, a document containing the employee’s name and National Insurance Number, a valid visa or permission to work documents etc.

TeamSpirit's HR system additionally provides the facility for obtaining police check and CRB check information, NI Number recording and trace facility. This part of the TeamSpirit system also allows HR departments to record which jobs require CRB checks, who has a valid CRB check, when CRBs are due to expire and forward planning of CRB charges. National Insurance Number checking and tracing allows TeamSpirit to report if TN numbers have been used and to create CA6855 to be sent to HMRC to request NI number reconcilliations.
